Welcome to Top Auto Detailing. These Terms of Service ("Terms") govern your use of our website, services, and any communications you receive from us, including SMS and email.

By using our services, booking an appointment, or providing your contact information, you agree to be bound by these Terms. If you do not agree, please do not use our services.

1. Services Overview

Top Auto Detailing provides professional mobile auto detailing services, including but not limited to:

  • Interior detailing
  • Exterior detailing
  • Full detail packages
  • Paint correction
  • Ceramic coating applications
  • Monthly maintenance programs
  • Additional detailing services and add-ons

All services are subject to availability and may vary based on location, vehicle condition, and other factors.

2. Booking and Appointments

2.1 Appointment Scheduling

Appointments can be scheduled through our website, phone, SMS, or email. All appointments are subject to confirmation by Top Auto Detailing.

2.2 Deposits and Payments

  • A deposit (typically 20% of the total service cost) may be required to secure your appointment.
  • Deposits are processed securely through our payment processor (Stripe).
  • The remaining balance is due upon completion of services.
  • We accept credit cards, debit cards, and other payment methods as specified.

2.3 Cancellations and Rescheduling

  • Cancellations made 48 hours or more before the scheduled appointment will receive a full refund of the deposit.
  • Cancellations made less than 48 hours before the appointment may forfeit the deposit.
  • Rescheduling is permitted with at least 24 hours' notice, subject to availability.
  • Top Auto Detailing reserves the right to cancel or reschedule appointments due to weather, emergencies, or other unforeseen circumstances. In such cases, a full refund or rescheduling will be offered.

2.4 No-Show Policy

If you fail to be present at the scheduled appointment time without prior notice, your deposit will be forfeited, and the appointment will be canceled.

3. SMS and Email Communications

3.1 Consent to Receive Messages

By providing your phone number and/or email address, you consent to receive:

  • Appointment confirmations and reminders
  • Service updates and notifications
  • Marketing and promotional messages (if you opt in)
  • Customer support communications

Consent is not a condition of purchasing any goods or services.

3.2 SMS Terms

  • Message frequency may vary depending on your interactions with us.
  • You must be 18 years or older to participate in our SMS program.
  • Message and data rates may apply based on your carrier's plan.
  • Carriers are not liable for delayed or undelivered messages.
  • You can opt out of SMS messages at any time by replying "STOP" to any message.

3.3 Email Marketing

  • You may receive promotional emails if you opt in during booking or signup.
  • You can unsubscribe from marketing emails at any time by clicking the "Unsubscribe" link at the bottom of any email.
  • Transactional emails (appointment confirmations, receipts) cannot be opted out of as they are essential to our service.

3.4 Data Privacy

We do not sell, rent, or share your contact information with third parties for their own marketing purposes. SMS opt-in data is only shared with service providers necessary to deliver messages (aggregators, SMS platforms).

4. Service Expectations

4.1 Customer Responsibilities

To ensure the best service experience, customers must:

  • Provide accurate vehicle information during booking
  • Ensure the vehicle is accessible at the scheduled time and location
  • Remove personal belongings and valuables from the vehicle
  • Provide access to water and electricity if required for mobile services
  • Inform us of any pre-existing damage, stains, or special conditions

4.2 Service Quality

  • We strive to provide the highest quality detailing services.
  • Service times are estimates and may vary based on vehicle condition and size.
  • We are not responsible for pre-existing damage, wear, or defects.
  • If you are unsatisfied with our service, please contact us within 24 hours for resolution.

4.3 Vehicle Condition

  • We reserve the right to refuse service if the vehicle is excessively dirty, hazardous, or unsafe.
  • Additional fees may apply for heavily soiled vehicles or extensive cleaning needs beyond the initial estimate.
  • We are not liable for damage caused by pre-existing conditions (failing clear coat, fragile trim, etc.).

5. Pricing and Fees

  • All prices are quoted in U.S. Dollars (USD).
  • Prices are subject to change without notice, but confirmed bookings will honor the quoted price.
  • Additional fees may apply for services not included in the base package (extra stain removal, specialty treatments, etc.).
  • Taxes and fees will be clearly stated before final payment.

6. Liability and Disclaimers

6.1 Limitation of Liability

To the fullest extent permitted by law:

  • Top Auto Detailing is not liable for damage resulting from pre-existing conditions, normal wear and tear, or improper vehicle maintenance.
  • We are not responsible for loss or damage to items left in the vehicle.
  • Our total liability for any claim shall not exceed the amount paid for the service in question.

6.2 No Warranties

While we take great care in our work, we make no warranties or guarantees regarding:

  • Complete removal of all stains, odors, or defects (some conditions may be permanent)
  • Prevention of future damage or wear
  • Compatibility with all vehicle types and materials

6.3 Indemnification

You agree to indemnify and hold harmless Top Auto Detailing, its owners, employees, and agents from any claims, damages, or losses arising from:

  • Your failure to disclose pre-existing damage or conditions
  • Your violation of these Terms
  • Misuse of our services or website

7. Intellectual Property

All content on our website, including text, images, logos, and branding, is the property of Top Auto Detailing and is protected by copyright and trademark laws. You may not use, reproduce, or distribute our content without prior written permission.

8. Third-Party Services

We may use third-party services for:

  • Payment processing (Stripe)
  • SMS and email delivery (GoHighLevel, Twilio, etc.)
  • Appointment scheduling and CRM

These services have their own terms and privacy policies, which we encourage you to review.

9. Dispute Resolution

9.1 Informal Resolution

9.2 Governing Law

These Terms are governed by the laws of the State of Michigan, without regard to conflict of law principles.

9.3 Arbitration

Any disputes that cannot be resolved informally shall be settled through binding arbitration in accordance with the rules of the American Arbitration Association, conducted in Michigan.

10. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be posted on this page with an updated "Effective Date." Your continued use of our services after changes are posted constitutes acceptance of the revised Terms.

11. Termination

We reserve the right to refuse service, cancel appointments, or terminate your access to our website or services at our discretion, including for:

  • Violation of these Terms
  • Abusive, threatening, or inappropriate behavior
  • Fraudulent activity or misuse of our services

12. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

13. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Top Auto Detailing regarding your use of our services.
